Conditions That May Violate Deed Restrictions
In addition to more specific restrictions on the top of page 2 of the deed restrictions states, in pertinent part:
NUISANCES: There shall not be erected, permitted, maintained, or operated upon any of the lands included in said tract any building, trade, or calling; nor shall any noxious, dangerous, or offensive thing, trade, or business, whatever be permitted or maintained or maintained on said property…nor billboard…
The following may be considered nuisances. This list is not all inclusive:
Homes and structures that are not maintained in good condition;
- Properties that are not kept in good condition;
- No commercial vehicles shall be parked on a street or driveway except at an active worksite;
- Parking is only permitted on streets (although discouraged overnight for safety reasons and during winter when snow plows are working) on paved driveways or in garages;
- Inoperable or unregistered vehicles shall only be parked in an enclosed garage;
- Boats, trailers, and recreational vehicles, as defined in the New Castle County Code, Chapter 7 (Land Use Code) Section 202, shall not be stored or parked in the open on any driveway or yard in Surrey Park. Recreational vehicles owned by visitors to the homeowner may be parked on the street in front of the owner’s home or the driveway for up to two weeks, provided that the vehicle owner obtains a permit required by New Castle County Code, Chapter 7, Section 302, Paragraph 8.5, and also obtains prior written approval by the deed committee. Recreational vehicles owned by the homeowner may be parked in the street in front of the owner’s home or driveway for no more than 48 hours, to facilitate loading and unloading;
- No signs or billboards shall be erected without prior approval by the deed committee. Exceptions are real estate signs where the property is for sale, or contractor signs at active work sites;
- Airbnb, Swimply, and similar short-term rentals of homes and properties are prohibited;
- Trash and debris must be stored and placed for pick up in proper containers so that it does not become an eyesore or hazard and containers must be removed from the curb at the end of the pickup day.
- Debris may not be stored outdoors.
